Terms & Conditions

 

Lux Darkroom is a photographic studio, darkroom, and gallery in London that provides a printing and editioning service, workshops, tuition, and other events in analogue and historical photographic processes. This document outlines the Terms and Conditions that apply to all the services we provide.
 
By signing up to our mailing list, purchasing goods or services from us, or booking a workshop, course, event, or private tuition session with us, you accept the following Terms and Conditions.

 

Definitions and Scope

  • "Lux Darkroom", "we", "us", or "our" refers to Lux Darkroom, a trading name of Mandarina Ltd.

  • "You", "your", "student", or "client" refers to the individual or entity purchasing or participating in our services.

  • These Terms apply to all bookings, purchases, and use of our services and facilities.

 

Course Booking

  • To book a workshop or private tuition session, full payment is required in advance. You may book via our website or contact us directly to arrange payment by bank transfer.

  • Bookings are non-transferable to other individuals. You must attend on the dates and times booked unless you request a change no later than 14 days prior to the workshop start date. Changes are subject to availability and are not guaranteed.

 

Cancellation Policy

  • Cancellations made 14 calendar days or more before the start of a workshop or tuition session are eligible for a full refund.

  • Cancellations made fewer than 14 days before the start date are not guaranteed a refund. However, we will endeavour to fill your place. If successful, we will refund the course fee minus a 15% administration fee.

  • To cancel, email us with your name, course details, and date of booking.

  • We reserve the right to cancel or reschedule a workshop or tuition session no later than 7 days before the scheduled start. In such cases, you will receive a full refund or be offered alternative dates.

 

Use of Facilities and Safety

By booking a workshop or tuition session, you agree to:

  • Handle all equipment with care.

  • Follow all safety procedures provided by staff, including use of protective gear.

  • Refrain from bringing food or drink into the studio.

 

We reserve the right to remove any participant who fails to comply with safety procedures and is deemed a risk to themselves or others. Participation is at your own risk.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence or that of our employees.

 

Age and Liability

  • All participants must be 18 years or older. 

  • Lux Darkroom accepts no liability for injury, accident, loss, or damage incurred during workshops or on the premises. You agree to indemnify and hold harmless Lux Darkroom, its staff, and affiliates from any claims arising from your participation.

  • Personal belongings are brought into the studio at your own risk. We are not liable for loss or damage unless caused by our proven negligence, in which case our financial liability is limited to the cost of replacement. We advise clients to ensure they have adequate personal insurance.

 

Editioning, Printing & Platemaking

Files and Printing Process

  • Please submit flattened, print-ready TIFFs at 360 or 720 dpi, converted to B&W and in 16-bit Adobe RGB colour.

  • Extra editing or retouching is charged at £60/hour. We will contact you if this is necessary.

  • For larger jobs or editions, a printer's proof must be approved and signed before final printing. We will retain this printer’s proof for our records.

  • Digital negatives/positives are tailored to our processes and may not be suitable for use elsewhere.

  • Prints are blind-stamped in the lower right-hand corner unless otherwise requested.

 

Turnaround, Collection & Delivery

  • Normal turnaround is 4–6 weeks from receipt of payment/deposit and image files, subject to the size and scope of the job, and whether any changes are requested.

  • Rush jobs may incur a surcharge (typically 20%).

  • Prints and plates can be posted or collected from our London studio. Postage, packaging and insurance are charged separately unless included in your estimate.

 

Payment Terms

  • You will receive an estimate before work begins. This estimate outlines the work and price, excluding postage unless specified.

  • A 50% deposit is required to begin editioning work. Single prints and plates must be paid in full in advance.

·       Your estimate may change if the scope of the job changes or additional work is required. We will contact you to discuss any changes.

  • The balance must be paid before collecting or shipping completed work. Work will not be released until full payment is received.

  • We reserve the right to charge interest on overdue payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

 

Returns & Cancellations

  • Under the Consumer Contracts Regulations 2013, custom-made goods, including prints and plates, are exempt from cancellation rights and are therefore non-refundable once work has begun.

  • Although custom-made goods cannot be returned, if you are dissatisfied with your order, please contact us within 7 days of receipt to discuss resolution.

 

Quality & Archival Stability

  • During the printmaking process, every care is taken to follow current best practice to ensure the longevity of the prints we make. However, all prints are susceptible to damage by environmental conditions and improper storage.

  • Handmade prints may contain minor imperfections or variations, reflecting their artisanal nature.

  • We are not liable for degradation after collection or delivery. Please contact us if you would like advice on print storage and display.

 

Intellectual Property

  • Clients retain copyright in all source materials. 

  • Lux Darkroom retains the right to keep printer’s proofs for reference. 

  • It is the responsibility of the client to ensure that they either own the copyright in any materials provided to Lux Darkroom or have obtained the necessary rights or permissions to reproduce, copy, or otherwise use those materials. Lux Darkroom accepts no liability for any third-party claims arising from copyright infringement or unlawful use of materials provided by the client.

 

Privacy and Data Protection

We are committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our Privacy Notice explains how we collect, use, and store your personal data. By using our services or booking with us, you consent to our use of your data as described in that notice.

General Legal Terms

Force Majeure: we are not liable for delays or failure to perform due to circumstances beyond our control (e.g. fire, flood, strikes).

Governing Law: these Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.

Severability: if any part of these Terms is found unenforceable, the rest remains valid.

Entire Agreement: these Terms constitute the entire agreement between you and Lux Darkroom and supersede all prior communications.
